DWI Law

One of my friends/family was arrested for DWI. Will they get out of jail automatically?

Some people are eligible for a personal bond. But this often takes 24 hours or more. I can usually speed up the process significantly. And trust me, everyone wants out of jail as soon as possible.

Can a DWI get dismissed?

Yes. But it depends on the circumstances of the arrest. Was there an accident? Did the driver take the Breathalyzer? Did the driver take the field sobriety tests? How does the driver look in the video?

Will my driver's license be suspended?

Most likely. But there are ways to postpone the suspension. And it is possible to win the ALR hearing - so the license is not suspended at all. Remember: You only have 15 days from the date of arrest to request an ALR hearing. You can do this by yourself, but it is more reliable to have an attorney do it.

Can I drive if my license is suspended?

Most people qualify for an occupational license. This license will allow you to drive twelve hours a day. It will have certain restrictions on it, but most people can get by just fine.

When should I hire an attorney?

Right away. Occasionally, there are time sensitive issues that must be addressed, such as tracking down witnesses. A good DWI attorney will also advise you on how to deal with some of the peripheral issues, such as alcohol classes and your driver's license.

How seriously does Travis County take DWIs?

Very seriously. However, this doesn't mean that they will be out to get you.

I didn't take the breathalyzer. Will my case be dismissed?

It depends on the circumstances of your arrest. Before the prosecutors dismiss a case, they will closely examine the arrest video and the police officer's offense report. Getting a case dismissed is not easy. Of course, you always have a right to a jury trial.

What is a reduction?

A reduction is when someone pleads guilty to obstruction of a highway or reckless driving instead of a DWI (which is dismissed). This usually requires probation on the reduced charge. The prosecutor must voluntarily offer a reduction as a plea bargain. In order for them to consider this, you must look very close to sober on the video.
